Understanding driving while suspended in Ontario

This charge alleges that you drove a motor vehicle on a highway at a time when your driver's licence was under suspension. The prosecution generally needs to establish both that you drove and that a suspension was in effect at that time.

The reason your licence was suspended matters. Suspensions arise from different sources — unpaid fines, medical grounds, demerit point accumulation, administrative measures, or a court order — and the consequences on conviction can differ depending on the underlying reason.

Notice is often an issue in these cases. Drivers are sometimes unaware a suspension is in effect, particularly where it arose administratively or from a fine default. Whether and how notice was given is one of the things disclosure should address.

What may be at stake

These are the kinds of consequences that can arise on conviction. They are described in general terms only.

Fine

A conviction carries a fine range that is significantly higher than ordinary moving violations, with higher ranges for subsequent findings.

Further licence suspension

A further period of suspension is available on conviction, on top of whatever suspension was already in place.

Vehicle impoundment

Depending on the nature of the underlying suspension, the vehicle may be impounded at the roadside.

Insurance

Insurers may treat a conviction of this type as a serious matter affecting eligibility as well as premium.

Possible imprisonment

Imprisonment is among the sentencing options available for this offence, particularly on repeat findings.

Court attendance

These matters proceed in Provincial Offences Court and typically involve a court appearance.

I did not know my licence was suspended. Does that matter?+

Knowledge and notice are frequently live issues in these cases, particularly where the suspension arose administratively or from an unpaid fine. How the case is approached depends on what disclosure shows about notice, so tell us your full history with the licence at the outset.

Why was my licence suspended in the first place?+

Suspensions come from several sources, including unpaid fines, demerit point accumulation, medical reporting, administrative measures and court orders. Part of our review is confirming exactly which applied to you and what has to happen to clear it.

Will my car be impounded?+

Impoundment can apply depending on the nature of the underlying suspension. Not every driving-while-suspended stop results in impoundment, but where it does, towing and storage costs fall to the owner.

Can I get my licence back while the charge is pending?+

Reinstatement depends on clearing the reason for the original suspension and meeting the Ministry's requirements, which is a separate track from the court case. In some situations both can be pursued at the same time.

Is imprisonment realistic on this charge?+

Imprisonment is among the available sentencing options, and it becomes a more serious consideration where there are repeat findings. We will give you a frank assessment based on your record and the specific allegation.

Can this charge be resolved without a trial?+

Some matters resolve through discussion with the prosecutor, sometimes after the underlying reason for the suspension has been addressed. Whether that is available is case-specific and cannot be promised.

What if I was only moving the car a short distance?+

The distance driven does not by itself take the conduct outside the offence, though the circumstances can be relevant to how the matter is dealt with overall. Set out exactly what happened when we review the case.
